Call for views on draft legislation: Supplementary Protection Certificate (SPC) waiver

The government ran a call for views in summer 2019 about proposals to fix retained SPC law. This government response sets out changes to this law to ensure it works at the end of the transition period.

There were six responses to the call for views, received from representative organisations of:

  • rightsholders
  • pharmaceutical innovators
  • legal representatives, and
  • the generic pharmaceutical industry

This government response provides a summary of these responses. It sets out the response to the points raised and changes made to the proposed approach following the call for views.

These changes are expected to be part of a range of measures to be included in forthcoming legislation. This will ensure the continued smooth operation of the UK’s intellectual property system after the transition period ends. It will also implement the intellectual property provisions of the Withdrawal Agreement. We expect the legislation to be laid in Parliament when time allows.

The government would like to thank those who responded to the call for views and participated in the associated meetings. These responses have helped further development of the legislation.
