The Competition and Markets Authority’s (CMA) response to the Department for Business, Innovation and Skills (BIS) consultation recognises the desirability of enhancing the efficiency, effectiveness and speed of the CMA’s investigations without compromising robustness and due process.

The CMA considers that it can make a number of process improvements without the need for statutory changes, and it welcomes the opportunity to work with government and stakeholders to identify appropriate areas of focus.

The response also recognises that statutory changes may facilitate enhancements in relation to certain markets, mergers and antitrust issues identified in the consultation – though the CMA considers that radical legislative changes are unlikely to be appropriate at present.
