Details

This amended Code of Practice provides guidance to prosecutors in England, Wales, and Northern Ireland on the use of investigation powers under the Proceeds of Crime Act 2002 (POCA). The Code of Practice has been updated to reflect the full commencement of the Criminal Finances Act 2017 amendments to POCA in Northern Ireland.

This code comes into force on 28 June 2021.

The Home Office and Department of Justice Northern Ireland have also published amended Codes of Practice.

Codes of practice are made under POCA to provide guidance to the persons exercising relevant functions under POCA and to establish procedural requirements to ensure that the functions concerned are exercised lawfully, proportionately, consistently and in a focussed manner. When functions covered by the Codes of Practice are revised or new functions are created, existing codes must be revised, and new ones made as necessary.
