Details
This regulatory position statement (RPS) does not change your legal requirement to have an environmental permit for a waste operation when you store mixed fuel from misfuelled vehicles.
However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement if you meet the requirements in the RPS.
The regulatory position does not apply to any other legal requirements.

Sites storing mixed fuel must apply for an environmental permit by 1 October 2024. You must renotify the Environment Agency if you are currently using this RPS. This RPS will be withdrawn on 1 October 2025. Updated to new RPS template and changed title to storage only.

The date the Environment Agency will withdraw this regulatory position statement has been extended to 1 July 2024.
