Commonhold was first introduced in England and Wales in 2002 but has failed to be used as a widespread form of homeownership. In 2020, the Law Commission published a report on reinvigorating commonhold as an alternative to leasehold ownership.

This paper sets out how this reformed commonhold model will operate, the government’s position on the Law Commission’s recommendations and the next steps for establishing commonhold as the default tenure in England and Wales.
