Notice of change of company name in the matter of company registration no 10608459.

In the name of INTELSTATS LIMITED and the application made to the Company Names Tribunal by INTEL CORPORATION.

On 15 October 2018 the company names adjudicator issued a decision ordering the respondent to the proceedings, INTELSTATS LIMITED, to change its registered company name to one that is not an offending name by 15 November 2018, in accordance with section 73(1) of the Companies Act 2006, subject to any appeal. No notification of a notice of appeal to the court in respect of the decision was received.

In the absence of any application by INTELSTATS LIMITED to change the registered company name, the adjudicator gave notice under sections 73(4) and (5) of the Companies Act 2006 on 3 December 2018 that the company name of INTELSTATS LIMITED was changed to 10608459 Limited. This change took effect upon the issue of the new certificate of incorporation showing the change of name, in accordance with section 73(6) of the Companies Act 2006.

The company name was changed to an offending name INTELSTATS (UK) LIMITED on 18 January 2019, in contravention of the adjudicator’s order dated 3 December 2018 under section 73(1) and in contravention of the notice given under sections 73(4) and (5) of the Companies Act 2006.

The adjudicator hereby gives notice under sections 73(4) and (5) of the Companies Act 2006 that the company name of INTELSTATS (UK) LIMITED is changed to 10608459 Limited. This change is to take effect upon the issue of the new certificate of incorporation showing the change of name, in accordance with section 73(6) of the Companies Act 2006.

The respondents, have a legal duty under Section 73(1)(b)(ii) of the Companies Act 2006 not to cause or permit any steps to be taken calculated to result in another company being registered with an offending name; this includes the current company. Non-compliance may result in an action being brought for contempt of court and may result in a custodial sentence.
