For the attention of personal injury claims managers

The recovery of hospital treatment and ambulance charges for the States of Guernsey – acting by and through the Committee for Health and Social Care (HSC) – commenced on 1 November 2017.

What does this mean?

The DWP Compensation Recovery Unit (CRU) will administer the recovery of hospital treatment and ambulance charges on behalf of HSC Guernsey. The scheme allows for recovery of charges for road traffic accidents only, occurring on or after 1 November 2017. The scheme is not retrospective.

The process

The scheme will run as far as possible in the same way as the schemes administered by the DWP CRU on behalf of the Department of Health and Social Care (DHSC) and Jersey Health and Social Services Division (HSSD).

However, the Guernsey scheme is a completely separate and distinct scheme to the DHSC and Jersey HSSD schemes already in place.

The DWP CRU, on behalf of the HSC who has responsibility for health services on the island of Guernsey and Alderney, will collect Guernsey and Alderney hospital treatment and Guernsey and Alderney ambulance charges from compensators.

Charges will be recoverable where a person makes a compensation payment in consequence of a road traffic accident suffered by and injured person, and the injured person has received Guernsey or Alderney hospital treatment, or used Guernsey or Alderney ambulance services, as a result of the road traffic accident

The Guernsey scheme will cover treatment received in the Guernsey or Alderney hospitals, including off-island treatment where a person has been admitted to either hospital first and has then been transferred. It is particularly important for compensators to note the separate legislation that covers each scheme.
