This draft guidance outlines both the civil and criminal offences under Part 12 of the Energy Act 2023. It is designed to improve compliance with the measures, setting out:

  • the statutory obligations
  • the enforcement regime which core fuel sector participants may be subject to should an offence be committed
  • the circumstances in which the Secretary of State may take action, and how they will exercise their functions in relation to enforcement undertakings
  • how the procedure for enforcement undertakings will work in practice

The guidance relates to those carrying out core fuel sector activities under section 268 of the Act as well as the offences under sections 271, 275 and 280.
