Letter from Secretary of State Kemi Badenoch to the Chairs of the Food Standards Agency and Food Standards Scotland requesting formal advice on the UK-CPTPP accession agreement

Dear Professor Jebb and Mrs Kelman,

As the UK’s Food Safety Authorities, I am writing to request joint advice from the Food Standards Agency (FSA) and Food Standards Scotland (FSS) on the UK’s agreement to join CPTPP, in line with the provisions of section 42 (4) of the Agriculture Act 2020 (“S.42”). Specifically, to request your advice on whether, or to what extent, the measures in the agreement – as signed on 16 July 2023 in New Zealand – are consistent with the maintenance of UK levels of statutory protection in relation to human health.

In producing your joint advice, I would request that the FSA/FSS focus on the areas within their statutory remit in the context of the relevant chapters of the agreement.

I would like to request that this advice be produced as an annex to be attached to the Government’s S.42 Report, and submitted electronically to the TAC mailbox (TACSecretariat@trade.gov.uk) by no later than 30 November 2023.
