Centro Waste Ltd - application
The application for a standard national goods vehicle operator’s licence, made by Centro Waste Ltd, is refused pursuant to Section 13A(2)(b) of the Goods Vehicles (Licensing of Operators) Act 1995 (”the 1995 Act”). The applicant is not of good repute.
H W Taroni (Metals) Ltd
Licence 0260479 held by H W Taroni (Metals) Ltd is suspended for a period of 14 days, with effect from 0001 hours on 1 November until 0001 hours on 15 November 2021. The suspension is pursuant to Section 26(1)(e) and (f) of the 1995 Act. Under Section 26(6) of the 1995 Act, I direct that the operator’s vehicles shall not be used under any other licence during the period of suspension.
The following undertakings have been added to the licence:
i) vehicles will be given laden roller brake tests at least four times a year, in addition to the one at MOT. Records will be kept for 15 months;
ii) the company directors will each attend an operator licence management course by 30 November 2021 and submit a copy of their certificate of attendance to the traffic commissioner’s office in Birmingham within seven days of the course taking place;
iii) an independent audit of the operator’s compliance with maintenance and drivers’ hours requirements will be carried out by the RHA, Logistics UK or other suitable independent body by 31 March 2022. The audit should cover at least the applicable elements in the attached annex. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to the traffic commissioner’s office in Birmingham within 14 days of the date the operator receives it from the auditor.
Licence OD0251812 held by Paul Jarvis is revoked with effect from 0001 hours on 1 November 2021 pursuant to Section 26(1)(f) and 27(1)(a) and (b) of the 1995 Act.
Transport manager Paul Jarvis has lost his good repute as a transport manager pursuant to schedule 3 paragraph 1 of the 1995 Act. Under paragraph 16(2) of that schedule, he is disqualified, with effect from 0001 hours on 1 November and for an indefinite period of time, from acting as a transport manager on any operator’s licence. Before he can apply for the restoration of his repute as a transport manager, he must first retake and pass the transport manager CPC examination.
Eric Gowland is disqualified, with immediate effect and for an indefinite period of time, from holding or obtaining any type of operator’s licence in any traffic area and from being the director of any company holding or obtaining such a licence, pursuant to section 28 (1), (4) and (5) of the 1995 Act.
