Decisions made in respect of David McAulay PG2065613

Pursuant to adverse findings under sections 17(3)(a) and (aa) of the Act, operator licence PG2065613 is revoked with immediate effect.

The operator’s repute is tarnished, but not lost.

No order for disqualification is made under section 28 of the Transport Act 1985.
Decisions made in respect of GM Buses Limited PG2071745

Application for a standard international public service vehicle operator’s licence is granted under sections 14 and 16 of the Act, with the condition that a maximum of 2 vehicles may at any one time be used under the licence.

The applicant agrees to the following undertakings being attached to the licence:
i. By 31 July 2024, David McAulay will attend a one-day Operator Licence Management course run by a trade association or professional body and will send the certificate of attendance at such course to cymru.wales@otc.gov.uk by 14 August 2024;
ii The operator will arrange an independent audit to be carried out by a DVSA-authorised audit provider, the RHA, Logistics UK or other equivalent independent body, by 31 December 2024. The audit will assess the systems for complying with maintenance and drivers’ hours requirements, and the effectiveness with which those systems are implemented. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to cymru.wales@otc.gov.uk by 14 January 2025; and
iii.The operator will require all its drivers when driving vehicles operated by it to do so using a driver card and tachograph record recording all driving, whether driving within scope of EU/AETR rules or not.
