Decision

i) Pursuant to adverse findings under sections 26(1)(b), 26(1)(c)(iii), 26(1)(ca), 26(1)(e), 26(1)(f) and 26(1)(h) of the Goods Vehicle (Licensing of Operators) Act 1995 and that the operator no longer meets the mandatory requirements for a transport manager, financial standing and good repute, the operator’s licence held by Direct Freight (Kelvedon) Ltd is revoked under section 27(1) with effect from 23:45 of 24 June 2022.

ii) Pursuant to section 28 of the above Act, Direct Freight (Kelvedon) Ltd is disqualified from holding or applying for an operator’s licence for a minimum period of 5 years. Stephen Richard Jordan is disqualified from applying for, holding, or being involved in the management of a licence for a period of 18 months.

iii) Pursuant to adverse findings under sections 26(1)(b), 26(1)(c)(iii), 26(1)(e), 26(1)(f) and 26(1)(h) of the above Act and that the operator no longer meets the mandatory requirements for a transport manager, financial standing and good repute, the operator’s licence held by Sylvia Joan Butcher is revoked under section 27(1) with effect from 23:45 of 24 June 2022.

iv) Pursuant to section 28 of the above Act, Sylvia Joan Butcher is disqualified from applying for, holding, or being involved in the management of a licence for a period of 3 years.

v) Determination of the application by AJ Logistic Services Ltd is held in abeyance for a period of 21 days from the date of the hearing (see Addendum below).
