The Deputy Traffic Commissioner for North West England decided:

On findings pursuant to Sections 26(1)(b), 26(1)(e), 26(1)(f) and Sections 13A and 17 of the Goods Vehicle (Licensing of Operators) Act 1995

  • A Formal Warning is issued to ERS Logistics Limited OC2058120;

  • A  Formal Warning is recorded against Transport Manager Emma Jane Corbett. Her good repute and professional competence are marked as tarnished but not lost;

  • The application to vary the Standard National Goods Vehicle operator’s licence of ERS Logistics Limited OC2058120 by changing the operating centre to Unit 2, Platt Fold Street, Leigh Lancashire WN7 1JH is granted in full with immediate effect.

  • The application to vary the Standard National Goods Vehicle operator’s licence of ERS Logistics Limited OC2058120 by increasing its authority to 4 vehicles is recorded as withdrawn.

  • The following undertaking offered by ERS Logistics Limited shall be recorded on the licence OC2064978:

i. ERS Logistics Limited will arrange an independent audit to be carried out by a DVSA-authorised audit provider, the RHA, Logistics UK, or other equivalent independent body, in December 2024. The audit will assess the systems for complying with maintenance and drivers’ hours requirements, and the effectiveness with which those systems are implemented. The audit should cover at least the applicable elements in the attached annex. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to the Office of the Traffic Commissioner at Golborne within 14 days of the date the operator receives it from the auditor and by no later than 31 January 2025;

ii. Certificates or other proof of attendance that Emma Jane Corbett has attended an Operator Licence Awareness Training Course and a Drivers Hours and Tachograph course will be provided to the Office of the Traffic Commissioner at Golborne within 28 days of attendance and by no later than 30 November 2024;

  • A Statement of Intent is recorded by Emma Jane Corbett on behalf of ERS Logistics Limited that articulated vehicles will not be operated under the licence from the operating centre at Unit 2, Platt Fold Street, Leigh Lancashire WN7 1JH without seeking the prior written consent of the Traffic Commissioner.
