Details

The Deputy Traffic Commissioner for London and South East England decided:

Operating centre

  • The application by Kingswood Pallets Ltd to base five vehicles and seven trailers at an operating centre at Oldhouse Lane, Bisley, GU24 9DB is granted, but at the reduced level of four vehicles and five trailers. Use of the operating centre is subject to a number of conditions and undertakings, as set out below.

Conditions

(i) there shall be no movement of the specified vehicles (i.e. HGVs specified on the licence) into or out of the Oldhouse Lane site before 0630 and after 2000 Mondays to Fridays; before 0730 and after 1400 Saturdays, or at all on Sundays and public holidays;

(ii) there shall be no more than 60 movements of the specified vehicles (each departure by a vehicle from the site and each arrival counting as a separate movement) per week, where a week is defined as 0001 on a Monday to 1400 on a Saturday (no vehicle movements Sundays or public holidays). The operator will keep a record of each week’s movements and submit this to the traffic commissioner’s office in Eastbourne at the end of every quarter;

(iii) the specified vehicles shall be driven at no more than 5 mph (i.e. a quick walking pace) while travelling on Oldhouse Lane;

(iv) vehicle and trailer combinations shall turn left out of Oldhouse Lane onto the A322 unless in exceptional circumstances it is unsafe to do so. The operator will keep a record of each occasion on which the “exceptional circumstance” provision has been used and submit this to the traffic commissioner’s office in Eastbourne at the end of every quarter;

(v) the specified vehicles shall enter and leave the operating centre in forward gear.

Undertakings

(i) the specified vehicles used under the licence will be equipped with tracker devices, to facilitate monitoring of the condition relating to the 5 mph maximum speed;

(ii) from 1 January 2025, the specified vehicles used under the licence will be equipped with forward facing cameras.

(iii) no more than three vehicles will be in operational use at any one time;

(iv) by 15 February 2025, the company will provide evidence of appropriate financial standing for four vehicles over the period 1 November 2024 to 31 January 2025. Finances must be in the name of the company;

(v) by 31 January 2025, transport manager John Urben will attend in person a two-day transport manager CPC refresher course. Courses must be run by one of the following bodies:

(a) a trade association (Logistics UK/RHA/BAR/CPT);
(b) a professional body (IoTA/CILT/SOE/IRTE);
(c) an approved exam centre offering the transport manager CPC qualification in goods transport;
(d) a firm of solicitors (or their associated training organisation) with significant experience with road transport regulatory and compliance issues (defined as having represented road transport operators and/or transport managers in at least 20 public inquiries over the past two years)
