DECISION
Sumi Travel Ltd
On findings in accordance with Sections 14ZA(2), 17(1)(a), 17(3)(a), 17(3)(aa), and 17(3)(c) of the Public Passenger Vehicles Act 1981
A condition is attached to the standard national operator’s licence of Sumi Travel Ltd PC1147021 with immediate effect limiting the number of authorised vehicles from 3 vehicles to 2 vehicles until further order.
The standard national public service vehicle operator’s licence of Sumi Travel Ltd PC1147021 is suspended for 14 days from 23:45 hours on Friday 19 May 2023 until 23:45 hours on Friday 9 June 2023.
I find the operator Sumi Travel Ltd does not meet the requirement of financial standing. I grant a period of grace until 31 August 2023 for the operator to provide evidence showing that the requirement of financial standing is met.
I find the operator Sumi Travel Ltd does not meet the requirement of professional competence. I grant a period of grace until 31 July 2023 for the operator to regain professional competence by completing the appointment of a suitably qualified Transport Manager (including approval of the appointment by the Traffic Commissioner) provide evidence showing that the requirement of financial standing is met.
The following undertakings offered by Sumi Travel ltd shall be recorded on the licence:

The operator will arrange an independent audit to be carried out by a DVSA-authorised audit provider, the RHA, Logistics UK, or other equivalent independent body, in October 2023. The audit will assess the systems for complying with maintenance and drivers’ hours requirements, and the effectiveness with which those systems are implemented. The audit should cover at least the applicable elements in the attached annex. A copy of the audit report, together with the operator’s detailed proposals for implementing the report’s recommendations, must be sent to the Office of the Traffic Commissioner at Golborne within 14 days of the date the operator receives it from the auditor and by no later than 30 November 2023.

The operator will provide original or copies (verified by the issuing bank or building society) of financial evidence in the name of Sumi Travel Ltd covering the period 1 May 2023 to 31 July 2023 inclusive to the Office of the Traffic Commissioner at Golborne by no later than 15 August 2023. This must show that the operator has continued to meet the required level of available finance throughout the period by reference to an average balance, dependant on the rates applicable at that time. Rates to be found in the Senior Traffic Commissioner’s Statutory Document No. 2 https://www.gov.uk/government/publications/traffic-commissioners-finance-march-2019 Where originals are not available each statement must be stamped and authenticated by the bank/building society.

All vehicles will undergo a roller brake test as part of at least every PMI. The results will be recorded, and the records will be kept for at least 15 months.
Transport Manager Salman Chohan
The good repute of Transport Manager Salman Chohan is lost, pursuant to Schedule 3 of the Act. Under paragraph 16 of that Schedule, he is disqualified from acting as a transport manager on any operator’s licence with effect from 20 April 2023 for 12 months until 20 April 2024.
