Decision

On a finding that the Operator has breached the requirements of the Operator’s Licence pursuant to sections 17(3)(a), 17(3)(aa), 17(3)(b), 17(3)(c) and 17(3)(e) of the Public Passenger Vehicles Act 1981, the condition on the Operator’s Licence is varied, under section 17(2)(d), so that the maximum number of vehicles which it might operate at any one time, is now reduced to 6. The operator’s repute is found to be tarnished.

On a finding that Gary Coldham has lost his repute as a Transport Manager pursuant to section 17(1)(b) and Schedule 3 of that Act, he is prevented from relying on his Certificate of Professional Competence unless and until he has worked with an experience and effective Transport Manager for a period of no less than 12 months from the date of this decision and can then demonstrate to a traffic commissioner that he can meet the statutory responsibilities.

On a finding that the operator no longer meets the requirement for professional competence, pursuant to section 17(1)(a) of the Act, the operator is granted a Period of Grace to nominate and have accepted a new Transport Manager.
