Decision Instrument 16: Revision to the Value for Money Standard and introduction of an associated Code of Practice

The revisions referred to in this supersede the Value for Money Standard which took effect from April 2012, following a consultation. The revised Standard and the Code of Practice are as set out in Annex 1 and Annex 2, respectively. This decision applies on 1 April 2018.

Decision Instrument 15: Amendment to the Tenant Involvement and Empowerment Standard

This sets out the decision of the regulator to revise the wording of Section 2.2.3 of the TIE Standard following a consultation on an amendment to the Tenant Involvement and Empowerment Standard arising from the changes introduced by the Housing and Planning Act 2016. This decision applies from 14 July 2017.

Decision Instrument 13: Notification of restructures and constitutional changes

Decision giving directions about notifications of registered society restructuring or dissolution, company arrangements and reconstruction and other constitutional changes

Following legislative changes that took effect on 6 April 2017, these directions from Decision Instruments 13 and 14 include:

  • removal of the constitutional consents regime
  • removal of the disposals consent regime
  • introduction of new notification requirements
  • the requirement for a decision on the registration of a new body arising from certain restructures
  • changes in requirements about the Disposal Proceeds Fund
  • amendment of the power to appoint board members and managers.

Decision Instrument 12: Charging of fees for social housing regulation

Following the consultation on introducing fees for social housing regulation this records the regulator’s decision about the principles in accordance with which the regulator’s fees are to be set and about the charging of fees to private registered providers from 1 October 2017.

Decision Instrument 11: Changes to registration criteria

The regulator consulted on revision to the registration criteria and the guidance on the use of intervention powers, arising from changes introduced by the Housing and Planning Act 2016 and the Welfare Reform and Work Act 2016. This direction applies from 6 April 2017.

Decision Instrument 10: Changes to the accounting direction

Following the consultation on changes to the accounting direction this decision is about the preparation of accounts by private registered providers of social housing, including regarding disposals proceeds funds. It arises from revisions to the regulatory framework and applies for accounting periods commencing from 1 April 2015.

Decision Instrument 9: Private registered providers’ disposal proceeds funds

Private registered providers of social housing are required by Section 177 (1) of the Housing and Regeneration Act 2008 (the 2008 Act) to show the net proceeds of certain types of disposal, payments of grant and repayments of discount (together referred to in this document as Net Disposal Proceeds) separately in their accounts as a Disposal Proceeds Fund. They must then use or allocate the sums in the DPF only as directed by the regulator. This decision applied from 1 April 2015 and ceased to apply from 6 April 2020.

Decision Instrument 8: Revisions to the regulatory framework

This decision sets out the revisions to the regulatory framework made by the Regulation Committee from 1 April 2015 (various of the existing requirements will remain unchanged), and records the publication of a code of practice in accordance with s195 of the Housing and Regeneration Act 2008. This decision applies from 1 April 2015.
