Guidance and notes on the changes to patent forms 28 and 30

1. Patents Forms 28 and 30
(a) These notes are not part of the Directions. They are intended to provide background and additional information.
(b) The Interpretation Act 1978 applies to these Directions. Therefore all the definitions set out in the Patents Act apply to these Directions. Further, amongst other things, generally any words importing the masculine gender include the feminine and words in the singular include the plural and words in the plural include the singular.
(c) Section 123(2A) of the Patents Act allows the comptroller to give directions specifying any forms the use of which is required by the Patents Rules.
(d) Both Patents Form 28 and Patents Form 30 have been revised as set out below.
Patents Form 28 (Application by the proprietor of a patent for an entry to be made in the register that licences under the patent are available as of right)
(e) Patents Form 28 has been revised to move the address box included on the reply slip to align it with the window envelopes we use within the Office.
2. Patents Form 30 (Application by the proprietor of a patent to cancel an entry in the register that licences under the patent are available as of right)
(f) Patents Form 30 has been revised to remove the reply slip. The Office uses an official letter to acknowledge receipt of the form rather than returning the slip to the customer.
