Equipment interference code of practice

This code of practice relates to the exercise of function conferred by virtue of Part 5 and Chapter 3 of Part 6 of the Investigatory Powers Act 2016.

Details

This code of practice is primarily intended for use by the public authorities able to authorise equipment interference activity under the act, namely:

  • the intelligence services (Security Service, Secret Intelligence Service (“SIS”)
  • Government Communications Head Quarters (“GCHQ”))
  • law enforcement agencies (listed at Schedule 6 of the Act)
  • Defence Intelligence (collectively referred to as “the equipment interference authorities”)

It will also allow other interested bodies to understand the procedures to be followed by the equipment interference authorities. This code is publicly available and should be readily accessible by members of any of the equipment interference authorities seeking to use the act to authorise equipment interference.
