Prior to introducing a fee the Home Office consulted the European Commission specifically DG Justice which is the Directorate responsible for Directive 2004/38/EC, about the criteria which ought to be applied when determining if a national document is similar to documentation issued under the Directive (2004/38/EC) for the purposes of Article 25(2).
