This regulatory position statement (RPS) does not change your legal requirement to assess and classify waste in accordance with waste classification technical guidance

However, the Environment Agency will not normally take enforcement action when you do not classify and assess waste in accordance with the guidance if you comply with the requirements in this RPS.

This enforcement position does not apply to any other legal requirements.

  1. We have updated the wording under 'When you must check back'. The update makes it clear that this RPS remains in place whilst the Environment Agency reviews it. It can be used until it is either removed from GOV.UK or marked as withdrawn.

  2. Updated this regulatory position statement (RPS) to clarify when it applies and how to comply with it. Updated the 'when you must check back' section.

  3. We have made it clearer that this RPS only applies to the utilities industry. We have added that this RPS allows you to move certain wastes as non-hazardous under a waste transfer note. We have extended the review date to June 2021, and the expiry date to 30 June 2022.

  4. We have extended the expiry date of this RPS until 31 January 2021.

  5. We have extended this RPS until 31 October 2020.

  6. We have extended the expiry date of this RPS until 30 April 2020.
