Extension to comply with new standard rules permits: RPS 331

This regulatory position statement (RPS) does not change your legal requirement to comply with the new standard rules permit when 3 months after publication, it replaces your existing standard rules permit.
However, the Environment Agency will not normally take enforcement action against you if you do not comply with this legal requirement provided that:
- your activity meets the description set out in this RPS
- you comply with the conditions set out in this RPS
In addition your activity must not cause (or be likely to cause) pollution of the environment or harm to human health, and must not:
- cause a risk to water, air, soil, plants or animals
- cause a nuisance through noise or odours
- adversely affect the countryside or places of special interest
1. Activity this RPS applies to
This RPS applies to permit holders of the following standard rules permits issued before 18 December 2024.
These permits:
- SR2008 No 11: inert and excavation waste transfer station with treatment
- SR2009 No 6: inert and excavation waste transfer station with treatment
- SR2010 No 12: treatment of waste to produce soil, soil substitutes and aggregate
have been revised and consolidated into SR2022 No 1: treatment of waste to produce soil, soil substitutes and aggregate.
This permit :
has been revised and consolidated into SR2022 No 2: mobile treatment of waste to produce soil, soil substitutes and aggregate.
These permits:
- SR2008 No 10: inert and excavation waste transfer station
- SR2009 No 5: inert and excavation waste transfer station
have been revised and consolidated into SR2022 No 3: construction, demolition and excavation waste transfer station.
These permits:
- SR2008 No 3: 75kte household, commercial and industrial waste transfer station with treatment
- SR2008 No 4: household, commercial and industrial waste transfer station with treatment (no building)
- SR2008 No 7: 75kte household, commercial and industrial waste transfer station with treatment and asbestos storage
- SR2008 No 8: household, commercial and industrial waste transfer station with treatment and asbestos storage (no building)
- SR2015 No 6: 75kte household, commercial and industrial waste transfer station with treatment
- SR2015 No 10: 75kte household, commercial and industrial waste transfer station with treatment and asbestos storage
have been revised and consolidated into SR2022 No 4: non-hazardous waste recycling with asbestos, hazardous batteries, cable and WEEE storage.
These permits:
- SR2008 No 1: 75kte household, commercial and industrial waste transfer station
- SR2008 No 2: household, commercial and industrial waste transfer station (no building)
- SR2008 No 5: 75kte household, commercial and industrial waste transfer station and asbestos storage
- SR2008 No 6: household, commercial and industrial waste transfer station with asbestos storage (no building)
- SR2015 No 4: household, commercial and industrial waste transfer station
- SR2015 No 5: household, commercial and industrial waste transfer station no building
- SR2015 No 8: household, commercial and industrial waste transfer station with asbestos storage
have been revised and consolidated into SR2022 No 5: non-hazardous waste transfer with asbestos, hazardous batteries, cable and WEEE storage.
These permits:
- SR2008 No 12: 75kte non-hazardous household waste amenity site
- SR2008 No 13: 75kte non-hazardous and hazardous household waste amenity site
- SR2015 No 19: 75kte non-hazardous household waste amenity site
- SR2015 No 20: 75kte non-hazardous and hazardous household waste amenity site
have been revised and consolidated into SR2022 No 6: household waste recycling centre.
These permits:
- SR2008 No 14: 75kte materials recycling facility
- SR2008 No 15: materials recycling facility
- SR2015 No 21: 75kte materials recycling facility
have been revised and consolidated into SR2022 No 7: materials recycling facility.
These permits:
- SR 2011 No 4: treatment of waste wood for recovery
- SR 2015 No 23: treatment of waste wood for recovery
have been revised and consolidated into SR2022 No 8: waste wood treatment.
2. Conditions you must comply with
You must comply with both:

your standard rules permit issued before 18 December 2024
-
the corresponding new standard rules permit by 27 June 2025
If not, you must apply for a bespoke permit by 27 June 2025 and continue to comply with your standard rules permit, issued before 18 December 2024, until your variation is determined.
3. Things to note
Due to delays in notification of the changes we will not enforce compliance with the revised standard rules permits until the 27 June 2025.
4. When you must check back
The Environment Agency intends to review this RPS on 27 June 2025.
The Environment Agency can withdraw or amend this regulatory position before the review date if they consider it necessary. This includes where the activity that this RPS relates to has not changed.
You will need to check back from time to time, including at and before the review date, to see if this RPS still applies.
You can subscribe to email updates about this RPS. These will tell you if the RPS has changed and when it has been withdrawn.
This RPS remains in force until it is removed from GOV.UK or is otherwise identified as having been withdrawn.
5. If you cannot comply with this RPS
If you operate under this RPS but can no longer comply with it, you must:
- stop the activity to which this RPS relates
- tell the Environment Agency immediately by email enquiries@environment-agency.gov.uk and put RPS 331 in the subject.
