  1. Section 3 has been amended as a result of changes in the Leasehold and Freehold Reform Act 2024 coming into force on 24 July 2024.

  2. As a result of customer feedback, we have added a paragraph to section 4 about our long-standing practice on informal apportionments and exonerations.

  3. Section 2.5 has been updated to clarify that a note will be added to the register if evidence of registration at Companies House is not lodged with the application in accordance with rule 111 of the Land Registration Rules 2003.

  4. Section 2.5 has been updated to clarify that a company is not obliged to register a rentcharge at Companies House as there is no longer a company law offence for failure to register a charge of any type at Companies House.

  5. Section 5 has been amended to clarify that where a rentcharge has been created in a transfer and a deed of variation is expressed to vary the transfer, all parties to the transfer should join in the deed of variation.

  6. This guide has been expanded and renamed. In addition to formal apportionment and redemption it now includes guidance on a variety of points which commonly arise in rentcharge applications.

  7. The guide has been amended as a result of the Senedd and Elections (Wales) Act 2020 by which the National Assembly for Wales became the Welsh Parliament, commonly known as the Senedd.
