Guidance on the operation of the subsidy control functions of the Subsidy Advice Unit

This guidance sets out how the Subsidy Advice Unit (SAU) will carry out its subsidy control functions in the UK Subsidy Control Regime.

The guidance explains the role of the Subsidy Advice Unit (SAU), which will be established within the Competition and Markets Authority (CMA) by the Subsidy Control Act 2022 (the Act) to provide independent non-binding advisory reports regarding certain subsidies that are referred by public authorities, and to periodically monitor and review the operation of the subsidy control regime.

The CMA consulted on guidance on the operation of the SAU. The consultation ran for 4 weeks, from 11 July 2022 to 10 August 2022.

The Department for Business, Energy & Industrial Strategy (BEIS) has separately published statutory guidance for the Act. The SAU’s guidance should be read in conjunction with the BEIS statutory guidance.
