Heat Networks Zoning Programme: privacy notice

This notice sets out how we will use your personal data, and your rights. It is made under Articles 13 and/14 of the UK General Data Protection Regulation (UK GDPR).
It is important that you read this notice, together with any other privacy notice that is provided to you on specific occasions when we are collecting or processing your personal data, so that you are aware of how and why we are using it.
This notice does not form part of any contract. This notice can be updated at any time; we will inform you if the way we handle your personal data changes.
Personal data is any information that can be used to identify a living individual, either on its own, or in combination with other pieces of data. Examples of personal data include your name and address.
The term ‘processing’ in relation to personal data, means any operation or set of operations which is performed on personal data or on sets of personal data (whether or not by automated means, such as collection, recording, organisation, structuring, storage, alteration, retrieval, consultation, use, disclosure, dissemination, restriction, erasure or destruction).
Your data
We will process the following personal data:
- salutation
- first name
- surname
- work title and areas of responsibility
- organisation name
- work email
- work telephone number
- working days
Purpose
We are processing your personal data for the purposes of:
- development of heat network policy
- development of understanding of local heat network potential
- analysis of heat and cooling use and availability across England
Legal basis of processing
The legal basis for processing your personal data is processing is necessary for the performance of a task (the collection, processing and dissemination of energy, geospatial and other commercial data sets required to carry-out the purposes detailed in the section titled ‘Purpose’) carried out in the public interest or in the exercise of official authority vested in the data controller, such as the exercise of a function of the Crown, a Minister of the Crown, or a government department; the exercise of a function conferred on a person by an enactment; the exercise of a function of either House of Parliament; or the administration of justice.
In this case the task being carried out in the public interest for which your personal data is being processed is for the collection and sharing of non-personal building, energy, geospatial and other data necessary for our heat network development work, requesting your input into that work and sharing relevant feedback.
Recipients
Your personal data may be shared by us with Zoning Programme participants including the Department of Energy Security and Net Zero (DESNZ), DESNZ’ Zoning Programme consultant support and implementation partners, local authorities and other government departments for the purposes detailed in the section titled ‘Purpose’. We may also share your data if we are required to do so by law, for example by court order or to prevent fraud or other crime.
- As your personal data will be stored on our IT infrastructure it will also be shared with our data processors Microsoft and Amazon Web Services.
Retention
We will retain personal your personal data in accordance with DESNZ’ data retention schedules which for policy development is 7 years.
Automated decision making
Your personal data will not be subject to automated decision making.
Your rights
You have the right to:
- request information about how your personal data are processed, and to request a copy of that personal data
- request that any inaccuracies in your personal data are rectified without delay
- request that any incomplete personal data are completed, including by means of a supplementary statement
- request that your personal data are erased if there is no longer a justification for them to be processed
- in certain circumstances (for example, where accuracy is contested) request that the processing of your personal data is restricted
- object to the processing of your personal data where it is processed for direct marketing purposes
- object to the processing of your personal data
International transfers
As your personal data is stored on our IT infrastructure and shared with our data processors Microsoft and Amazon Web Services, it may be transferred and stored securely in the UK and European Economic Area. Where it is the case that your personal data is stored outside the UK and EEA it will be subject to equivalent legal protection through the use of Model Contract Clauses.
Complaints
If you consider that your personal data has been misused or mishandled, you may make a complaint to the Information Commissioner, who is an independent regulator.

Changes to this privacy notice
We reserve the right to update this privacy notice at any time, and we will provide you with a new privacy notice when we make any substantial changes. We will also notify you in other ways from time to time about the processing of your personal data.
Change of purpose
We will process your personal data for the purpose for which we collected it. If we process your personal data for another purpose that we reasonably consider to be compatible with the original purpose, we will notify you and explain the legal basis which allows us to do so.
Additional information relating to commercial data transfers
Commercial data and information provided to the Zoning Programme will be processed for the following purposes.
Data usage
Data collected will be used by DESNZ and programme consultants to carry out the following activities to:
- inform a heat mapping exercise
- identify zonal heat network opportunities to support the development of understanding of local heat network potential
- inform a techno-economic model and delivery exercise that the programme is working towards to identify a scalable network within a study area
- support HN policy design, development and modelling
Data sharing
Data and programme outputs may be shared with zoning programme participants including:
- the Department of Energy Security and Net Zero (DESNZ)
- Ofgem
- DESNZ’ Zoning Programme consultant support and implementation partners
- local authorities
- other government departments
for these purposes:
- it is likely due to engagement activities, data will be shared (visually on a map or textually in a report, rather than in the raw format) with:
- the other boroughs and stakeholders in the study area, for example data may be shown to neighbouring local authorities especially where potential zones could cross boundaries and fall into multiple administrations
- other programme participants in other locations for example when sharing learnings across projects
- Ofgem and other government departments to inform zoning policy design
- sensitive datasets (such as potential new build developments or proposed industrial sites) that have been specifically flagged as commercially sensitive by the programme participant at time of data collection will not be made public or shared beyond the parties mentioned above (and not in raw form at all) without prior approval
