Privacy notice: statutory blight claims for Heathrow expansion

This privacy notice applies if you provide the Secretary of State for Transport or Heathrow Airport Limited with personal data in connection with a blight notice relating to land near Heathrow Airport (or somebody, for that purpose, has provided that personal data on your behalf).
The personal data the Secretary of State or the other persons listed below may process in connection with the blight notice are:
- your name
- your address
- your interest in the property including the tenure (e.g. leasehold or freehold), when you acquired the interest, names and addresses of landlords or other owners who also have an interest in the property including mortgagees (lenders)
- information about the property: its location, its use, your history of occupation of it or of its being vacant, names and addresses of other occupiers of the property
- information evidencing your occupation of the property
- information about attempts you have made to sell the property
- information required to be provided under the 1990 Act in connection with the blight notice.
The Secretary of State has statutory functions to perform because of the blight notice. These arise under Chapter 2 of Part 6 of the 1990 Act, which establishes a statutory scheme for dealing with statutory planning blight, including in certain cases acquiring property interests and paying compensation.
The work undertaken in the performance of these functions (the ‘primary task’) is a task carried out in the public interest and it is necessary for the performance of that task that the Secretary of State or other persons listed below process the personal data provided in connection with the blight notice.
In connection with the primary task the Secretary of State also has the task (the ‘secondary task’) of doing or remaining capable of doing the following things, each in relation to his performance of the primary task: defending decisions made in the public interest; ensuring that a court or tribunal hearing proceedings connected with alleged improper administration may be assisted properly, and pursuing claims for redress (including by means of proceedings) where there has been a mistake or fraud.
The secondary task could not be performed without the personal data as the decision or administrative activity in question could not be identified without it or, in the case of claims for redress, the proposed defendant could not be identified.
The secondary task is a task carried out in the public interest and it is necessary for the performance of that task that the Secretary of State or other persons listed below process the personal data you have provided in connection with the blight notice giving rise to the primary task.
The following persons may also be provided with the personal data you have provided in order to assist the Secretary of State to carry out the primary and secondary tasks:
- Heathrow Airport Limited, a company, registered in England and Wales which manages and administers blight notices for the Secretary of State;
- DLA Piper UK LLP, a limited liability partnership, registered in England and Wales which the Secretary of State has appointed to provide him with legal advice in connection with blight notices;
- organisations and individuals that have a legitimate interest in the purchase and/or sale of land and property under the statutory blight regime administered by Heathrow Airport Limited. These organisations may include accountants, lawyers, surveyors and external evaluators
- The Secretary of State has a duty of due diligence and care to protect public funds. As a result your personal data may be shared with other government departments and agencies in order to prevent and detect crime and possible fraudulent practice.
Your personal data will be retained by the Secretary of State for seven years following completion of the statutory blight process or determination of any proceedings relating to an objection to a blight notice.
