In early 2024, the previous government appointed Lord Banner KC to lead an independent review into the causes of legal challenges brought against the NSIP regime and to explore the scope and options for improving existing processes.
The review makes a case for changes to the judicial review process to reduce delays to NSIPs whilst maintaining access to justice and ensuring that the UK upholds its international obligations.
The government is opening a call for evidence to seek views on the review’s findings and recommendations, and to gather additional suggestions for proposed changes that could help to address delays arising from judicial reviews against Development Consent Order decisions.
