Dear
Re: Freedom of Information Act (FOIA) Request
Thank you for your email of 2nd February 2022 in which you requested from the Insolvency Service:
“provided with a breakdown of DRO numbers in Calderdale for 2020 and 2021 based upon each competent authority / authorising body”
Your request has been dealt with under the Freedom of Information Act 2000 (FOIA).
I can confirm the agency holds the information that you have requested
For Debt Relief Orders (DROs) by competent authority in Calderdale in 2020, I have compiled a summary table below that covers the period 1 January to 31 December 2020
Competent Authority | Count |
---|---|
Community Money Advice | 169 |
National Association of Citizens’ Advice Bureaux | 33 |
StepChange Debt Charity | 25 |
National Debtline | 1 |
Christians Against Poverty | 1 |
Under Section 16 of the Act (Advice and Assistance) you may find it useful to note:
DROs involve a partnership between the Insolvency Service and the professional debt advice sector. The division of responsibility is that approved intermediaries working for competent authorities will assist the debtor in making an application for the DRO to The Insolvency Service via an online application form. The Insolvency Service is the agency responsible for assessing the application, granting the DRO and administering the effects.
A small number of DROs (38, representing less than 0.2% of the full dataset) in England and Wales do not have postcode information available and have therefore not been included. Declined DROs are not included, however DROs that were initially approved but later revoked or under enquiry are included. Please note that while the numbers of these cases are small (3 cases in Calderdale were revoked; 0 under enquiry), this methodology does not align with a previous FOI (FOI2021/22-022) in which the numbers did not include approved cases that were later revoked, nor those that were under enquiry at the time the information was compiled.
In addition to the changes to the methodology outlined above, data on individuals that have entered insolvency are sourced from a live administrative system owned and managed by the Insolvency Service. This means that the totals may therefore not match those previously published from the agency’s Location, Age and Gender Statistics.
For DROs by competent authority in Calderdale in 2021, I can confirm the agency holds the information that you have requested, however, the information is exempt from disclosure under section 44(1) of the act and the information is therefore refused.
Section 44(1) Information is exempt information if its disclosure (otherwise than under this Act) by the public authority holding it:
(a) Is prohibited by or under any enactment,
(b) Is incompatible with any retained EU obligation, or
(c) Would constitute or be punishable as a contempt of court.
Individual insolvency statistics by location are published annually as Official Statistics. Therefore, while meeting the legal requirements of the FOIA, the Insolvency Service is also obliged under section 13 of the Statistics and Registration Service Act 2007 to continue to comply with the Code of Practice for Official Statistics, and specifically, the Pre-Release Access to Official Statistics Order 2008. The latter requires the producers of official statistics to ensure that no indication of the substance of a statistical report is made public or given to the media or any other party not recorded as eligible for access prior to publication.
The 2021 statistics for individual insolvency by location, age and gender, which will include the number of DROs in Calderdale, will be published on 1 April 2022.
