Thank you for your email of 22 February in which you requested from the Insolvency Service:

1) Would you provide information as to how a receiver in Bankruptcy get appointed by who it get appointed.

2) What documentation is the public supposed to see regarding such appointment.

3) Are these documents supposed to have the wet ink signature of the man or woman making the appointment.

Your request has been dealt with under the Freedom of Information Act 2000 (FOIA).

I can confirm the agency holds the information that you have requested and I have provided answers to your questions below:

  • Would you provide information as to how a receiver in Bankruptcy get appointed by who it get appointed.

Official receivers are appointed to administer all bankruptcies in England and Wales under the provisions of the Insolvency Act 1986. Official receivers are appointed and removed from office by the Secretary of State. This Secretary of State function is carried out by an employee of the Insolvency Service.

  • What documentation is the public supposed to see regarding such appointment.

Bankruptcy orders and details of the official receiver appointed to the case are published in the London Gazette There is no requirement for any publication of the appointment of an individual as an official receiver.

  • Are those document supposed to have the wet ink signature of the man or woman making the appointment.

A wet signature is not required on any documents confirming the appointment of an official receiver.
