We have received a request under the Freedom of Information Act 2000 (FOIA) about internal IND guidance on asylum seekers:

  1. Any and all internal guidance given to IND caseworkers and immigration officers in relation to information to be provided to asylum applicants pursuant to IR 358 and IR358A, particularly guidance in relation to determining the language that asylum applicants may reasonably be supposed to understand and on the detail of information that is to be provided.

  2. Any and all guidance given to IND caseworkers and immigration officers on the suspension or discontinuation of support pursuant to Regulation 20(3) of the Asylum Support (Amendment) Regulations 2005, particularly guidance in relation to taking individual, objective decisions to withdraw support and to determining whether a person has special needs.

  3. Any and all internal guidance given to IND caseworkers, immigration officers, and local authorities pursuant to Article 18(1) of the Directive, particularly in relation to determining whether (i) support decisions involving minors, such as on location of accommodation, transfer of accommodation, etc, reflect the best interest of the child; and (ii) detention decisions involving minors reflect the best interest of the child.
