Details

Changes in Intellectual Property Office (IPO) practice in relation to Supplementary Protection Certificates (SPCs).

In particular, the IPO will be carrying out additional checks on the validity of an SPC when preparing for its entry into force. It will also follow the practice used for patents of staying surrender applications where there are ongoing invalidity proceedings that may affect the SPC. SPC holders should inform the IPO whether any such proceedings are underway when applying to surrender.
