1. Collaboration agreement

1.1 Find out about the Collaboration Agreement (CA)

Information on the agreement between HM Land Registry and local authorities.

1.2 What is it

This is an agreement between HM Land Registry and a local authority. The CA authorises the digitalisation of local authority data. It then transfers the responsibility of local land charges (LLC) from the local authority to HM Land Registry.

The CA means both parties agree to collaborate. This means HM Land Registry becomes the registering authority for LLC. This is in accordance with Schedule 5 to the Infrastructure Act 2015 and sets out the respective rights and obligations of both parties.

The Collaboration Agreement contains 2 Schedules:

  • Schedule 1 – describes the Authority Data supplied to HMLR
  • Schedule 2 – sets out the specific process for the transmission of the Authority Data to HM Land Registry

1.3 When it is signed

We issue the CA during early engagement with the local authority. They must complete it before sharing the data with HM Land Registry.

We recommend sharing the document early with the legal department in your local authority.

1.4 What happens next

The local authority and HM Land Registry work together to undertake a mobilisation meeting and agree a delivery plan. The CA is valid for 2 years before going live (with option to extend).

This qualifies the local authority for the initial transition payment and permits local authority’s data to go live on HM Land Registry’s register.

2. Terms of Collaboration (ToC)

2.1 What is it

Terms of Collaboration (ToC) is an agreement between HM Land Registry and a local authority. It authorises HM Land Registry to receive data from the local authority and begin data assessment activities.

Under the agreement, the local authority makes its Local Land Charge (LLC) data available to HM Land Registry. This includes both the textual and spatial elements to:

  • analyse where authority data is not suitable for migration
  • identify areas needing work before to migration
  • identify areas of data enhancement during migration by applying HM Land Registry business rules

2.2 When it is signed

We issue the ToC during early engagement with the local authority. They must complete it before sharing the data with HM Land Registry.

2.3 What happens next

The local authority’s complete dataset of LLC records goes to HM Land Registry to go through the Data Analysis Dashboard (DAD). This includes both the textual and spatial elements

The ToC is valid for 12 months (with option to extend).

The DAD allows early insight into the local authority’s data and improvement work. This needs to meet the required standard for inclusion on the digital register.

On completion, the local authority can progress through Early Engagement and into service migration.
