MOJ has written to the Employment Tribunal in relation to the O’Brien/Miller & Others litigation, following the judgment of the Court of Justice of the European Union on 7 November 2018.

MOJ’s letter to the Employment Tribunal confirms to all affected fee paid judicial office holders the MOJ approach to claims for pre 7 April 2000 service. All judges with an existing or potential claim (either with the Tribunal or JPCT) are invited to read the letter.
The moratorium on pension claims provided by MOJ in relation to the O’Brien / Miller & Others litigation continues.
The purpose of the moratorium is to remove the need for potential claimants to lodge ‘protective’ claims.
The moratorium provides that if a judicial office holder is a potential claimant, MOJ will treat him or her as if he or she had issued a pension-related claim as at 1 March 2013 and that the claim had been stayed.
