Details

This report sets out the Care Quality Commission’s (CQC) findings from engagement with people subject to the Mental Health Act 1983 (MHA) and review of services registered to assess, treat and care for people detained using the MHA.

To inform the report, CQC carries out visits to check how mental health services are providing medical treatment to people detained under the MHA and are supporting patients to recover.

The 2018 to 2019 report highlights 5 key areas of concern. These include:

  • the use of human rights principles and frameworks
  • involvement in care
  • people in long-term segregation
  • access to care and treatment
  • the interface between the MHA, the Mental Capacity Act 2005 and the Deprivation of Liberty Safeguards
