Privacy notice relating to the National Concessionary Fuel Scheme

This notice sets out how we will use your personal data, and your rights. It is made under Articles 13 and 14 of the UK General Data Protection Regulation (UK GDPR).

Your data

Purpose

The purpose for which we are processing your personal data is to administer and deliver Concessionary Fuel benefit (Cash-in-Lieu or Solid Fuel) entitlements to eligible concessionaires and for debt recovery services on behalf of DESNZ:

  • your data will be used by our contractors, the Data Processors
  • your data will not be shared or disclosed to any other parties without your explicit consent
  • the data you provide will not be transferred outside the United Kingdom

The data

We will process the following personal data:

  • your address and property details
  • your bank details
  • your date of birth
  • email address
  • your employment details
  • gender
  • maiden name
  • name
  • National Insurance number
  • phone number
  • postcode
  • scanned documents
  • spouse details

Why we need it

The purpose for which we are processing your personal data is to determine whether you are eligible for a Concessionary Fuel entitlement under the Fuel Agreements and at what level that might be.

The legal basis for processing your personal data:

  • Legal Obligation: it is necessary to comply with a legal obligation under the Coal Industry Act 1994 to service concessionaires with either Cash-in-Lieu or Solid Fuel as prescribed under various contractual fuel agreements.

What we do with it

Your personal data will be shared with:

  • Capita Pension Solutions Ltd, part of Capita Plc
  • Homefire Group Ltd
  • Cabinet Office as part of the National Fraud Initiative and fraud prevention and/or detection bodies for the purpose of assisting the prevention and detection of fraud. Further details about NFI are available at: www.gov.uk/government/collections/national-fraud-initiative

Our lawful basis for processing under the UK General Data Protection Regulation (UK GDPR) is ‘public task’.

We will not supply your data to third parties without your explicit consent.

We will share your data if we are required to by law – for example, by court order, or to prevent fraud or other crime.

Retention - how long we keep your data

We will only retain your data for as long as:

  • the law requires us to
  • we need to provide this service to you

Your rights

You have the right to:

  • request information about how your personal data is processed
  • request a copy of any personal data you have provided in an accessible format
  • request that anything inaccurate in your personal data is corrected immediately
  • raise an objection about how your personal data is processed
  • request that your personal data is erased if there is no longer a justification for it
  • request that the processing of your personal data is restricted in certain circumstances
  • withdraw your consent at any time where DESNZ is relying on consent to process your personal data
  • to the extent that you are providing your personal data in relation to determining eligibility to a Concessionary Fuel entitlement the failure to provide this information will mean that any application will not be able to be processed

Changes to this notice

We may modify or amend this privacy notice at our discretion at any time. When we make changes to this notice, we will amend the last modified date at the top of this page. Any modification or amendment to this privacy notice will be applied to you and your data as of that revision date. If these changes affect how your personal data is processed, DESNZ will take reasonable steps to make sure you know.
