This document contains a model for aspirant NHS foundation trusts to use when they draw up their constitution. It has been updated following the introduction of the Health and Social Care Act 2012.
The documents are available in Word and PDF formats.
Updated model election rules
New model election rules were published in August 2014.
The new rules:
- allow members to vote for foundation trust governors using e-voting technology
- set out that challenges to the conduct of foundation trust elections will now be determined by the Independent Elections Arbitration Panel instead of Monitor
NHS trusts applying to Monitor for foundation trust status after 1 October 2014 must:
- use this version of the rules in their draft constitutions
- hold their first elections in line with them
References in the model core constitution to the ‘model election rules as published from time to time by the Department of Health’ should now be read as references to the new version of the rules published by the FTN.
The rules were updated and published by the FTN in partnership with Lancashire Teaching Hospitals NHS Foundation Trust.
