On 19 May 2021, the North Sunderland Harbour Commissioners (“the applicant”) made a formal application to the Marine Management Organisation (“MMO”) under Section 14 of the Harbours Act 1964 for a Harbour Revision Order (“HRO”).
If made, the proposed HRO would define the limits of North Sunderland Harbour. The proposed HRO would also modernise the Commissioners’ powers to manage and regulate the harbour, including power to give general and special directions, charge ship, harbour and goods dues, control works and dredging, borrow and use money and amend and revoke certain statutory provisions regulating the harbour. The proposed HRO also sets out the penalty for offences for failure to comply with directions. If made, the proposed HRO would alter the constitution of the North Sunderland Harbour Commissioners to provide for the Commissioners to consist of a body of 9 directly appointed members, replacing the previous arrangements of some of the 9 members being appointed or elected by other organisations.
More information about the proposals can be viewed in the statement in support and the draft HRO. The statutory 42-day public consultation on the HRO starts on 2 March 2023 and ends on 12 April 2023. An objection or representation should:
- Be received before the expiry of a period of 42-days consultation period;
- Be made in writing and quoting reference HRO/2021/00001;
- State the grounds of the objection or representation;
- Indicate who is making the objection or representation; and
- Give an address to which correspondence relating to the objection or representation may be sent.
