Notice to Traders 19/20 - Poultrymeat Import Quota.

Introduction
This notice is to tell you about the quantities available for the Poultrymeat import quotas under Commission Regulation (EC) No. 616/2007 for the sub period 1 October 2020 to 31 December 2020.
The products and quantities available are detailed in Annex 1 attached.
The application period
For the sub period 1 October 2020 to 31 December 2020 you may apply for import licences and import rights between 1 July 2020 and midnight on 7 July 2021.
It is your responsibility to check that the application and all additional documentation is correct at the time of submission.
Note: We will reject any applications (including supporting documents), securities received after midnight on 7 July 2020 or proof of trade received after 5pm on 7 July 2020.
Proof of trade
If it is your first application of the quota year you must provide evidence to show that you imported at least 50 tonnes (non group 5A or 5B) or 250 tonnes (Group 5A or 5B) of product covered by Annex 1 part XX to Regulation (EC) No. 1234/2007, or of salted poultrymeat under CN code 0210 9939, during:
- the 12 month period immediately prior to the time of your application; and
- the 12 month period immediately prior to that.
Note: We will reject your application if there is not enough tonnage to qualify.
You must supply the original import document (C88) form, or a copy certified as a ‘true copy’ of the original stamped by Customs. We will not accept photocopies of the Customs stamp or scanned versions of these documents.
Proof of trade - processors (non Group 5A or 5B)
If you are a processor you must provide evidence to show that during both the 12 month period immediately prior to your application and the 12 month period immediately prior to that, you processed at least 1,000 tonnes of:
- poultrymeat under CN code 0207 or 0210 to produce preparations of poultrymeat of CN code 1602; or
- homogenised preparations of preparations under CN code 1602 1000 that contain no other meat than poultrymeat.
You must provide processing records that prove receipt and processing of the raw material into one of the accepted preparations. Proof of processing should consist of a spreadsheet containing the following information:
- the delivery dates of the raw product;
- a description of the raw product;
- the quantity of the raw product; and
- a description of the end product.
In addition to the spreadsheet the following proof is also required:
- commercial documents in the form of production records (cooking/processing records) to prove that processing of the quantity of poultrymeat entered on the spreadsheet took place within the two qualifying 12 month periods; and
- a covering letter confirming the CN codes of the raw product and processed product.
You only need to send a selection of processing records spanning the two 12 month periods with your application. You should keep the remaining records available at the processing establishment for us to verify at a later date.
Supporting documents
If it is your first application of the quota year you must send us a valid VAT certificate when submitting your application. If you are registered as part of a group you must provide a valid VAT certificate that lists each company within the group.
Licence applications
In box 8, the country of origin:
- you must put a cross in the ‘Yes’ box for order numbers 09.4211, 09.4212, 09.4214, 09.4217, 09.4251, 09.4252, 09.4253, 09.4269 and 09.4283 and a cross in the ‘No’ box for all other order numbers.
in box 20, special particulars:
- you must state the regulation number and order number that you are applying under.
Applications under order numbers 09.4211, 09.4212, 09.4214, 09.4217, 09.4251 and 09.4252 must be for a minimum of 100 tonnes.
Applications under order numbers 09.4213, 09.4216, 09.4218, 09.4253, 09.4260, 09.4261, 09.4262, 09.4263, 09.4264, 09.4265, 09.4266, 09.4267, 09.4268, 09.4269 and 09.4283 must be for a minimum of 10 tonnes.
Licence / rights securities
Licence applications under order numbers 09.4211, 09.4214, 09.4217, 09.4251, 09.4252 and 09.4253 must be accompanied by a security of €10 per 100kgs.
Licence applications under order numbers 09.4212, 09.4213, 09.4216, 09.4218, 09.4260, 09.4261, 09.4262, 09.4263, 09.4264, 09.4265, 09.4266, 09.4267, 09.4268, 09.4269 and 09.4283 must be accompanied by a security of €50 per 100kgs.
Rights applications under order number 09.4215, 09.4254, 09.4255, 09.4256, 09.4257, 09.4258 and 09.4259 must be accompanied by a security of €35 per 100kgs.
In box 11 (for licences) or part C of form PEP – A (for rights) you should state:
- the amount of security expressed in the same unit of currency that your guarantee is lodged;
- the type of security, for example ‘block guarantee’, ‘cash’ or ‘single transaction guarantee’; and
- the trader number of the block guarantee holder if you are using another trader’s block guarantee.
If you are using another trader’s block guarantee you must make sure that your cross reference details are set up before you send us your application.
Note: We will reject your application if the cross reference is not set up and you do not submit security in another format within the application period.
Note: We will not accept any amendments to block guarantees after the application period has closed. This includes cross reference amendments.
Licence validity
Your non Group 5A or 5B licence will be valid from the first day of the subperiod until 30 June of the same quota year.
Your Group 5A or 5B rights will be valid from the first day of the subperiod until 30 June of the same quota year.
Release of security
You must return your paper licences within 45 days of the expiry date or you will forfeit your security.
Security against the main electronic licence (excluding extracts) will be released automatically upon attribution of at least 95% of the licence quantity.
Your Group 5A or 5B rights security will be released proportionately when licences are applied for.
Transfer of rights
The rights of licences for Group 5A or 5B may only be transferred to companies that have satisfied the proof of trade requirements detailed in this notice. The rights of a licence can only be transferred once, to the nominated transferee. Further transfers of rights are not permitted, other than to transfer the rights back to the original licence holder.
The rights of licences for non Group 5A or 5B are not transferable
Animal and public health
To protect animal and public health, all products of animal origin may be subject to veterinary conditions or restrictions. You can call the Animal and Plant Health Agency Carlisle on 01228 403600 for advice on whether and under what conditions imports are allowed.
