NTE 2023/19: The Export Control (Amendment) (No 2) Regulations 2023

Introduction
The Export Control Joint Unit (ECJU) has amended the Export Control Order 2008 (“the 2008 Order”) and the retained Council Regulation (EC) number 428/2009 of 5 May 2009 setting up a community regime for the control of exports and the transfer, brokering and transit of dual-use items (“the retained Dual-Use Regulation”).
The Export Control (Amendment) (No 2) Regulations 2023 (SI 2023 No. 1048) will come into force on 23 October 2023.
Legislative amendments
These Regulations amend the 2008 Order, and the retained Dual-use Regulation as follows.

It removes Syria from Part 2 of Schedule 4 to the 2008 Order. This does not represent a change in approach on licensing for Syria. A 2013 instrument which placed Syria into Part 4 of Schedule 4 was unclear as to whether it also removed Syria from Part 2, as intended. Therefore, this change remedies an historic ambiguity in the 2008 Order as to the position of Syria in Schedule 4.

It corrects 2 drafting errors introduced by the Export Control (Amendment) Regulations 2023 (S.I. 2023/695) in which words already contained in the retained Dual-Use Regulation were inserted a second time. The errors do not have an impact on the operation of the retained Dual-use Regulation and have been corrected for the sake of good order.
The consolidated list of strategic military and dual-use items that require export authorisation will be amended and republished in due course.
