NTE2024/16: global combat air programme (GCAP) open general licence and the eligibility letter from the UK Ministry of Defence

Introduction
The Export Control Joint Unit (ECJU) has published the Open General Licence (Global Combat Air Programme).
This licence will permit the export of dual-use items or military goods software or technology and trade of military goods for the design, development, production, maintenance, trials and testing or use of the Global Combat Air Programme.
To use this licence, you must hold an eligibility letter from the UK Ministry of Defence (MOD).
What you need to know
This open general licence may be used by specified exporters who are contracted to work on GCAP by the governments of the United Kingdom, Italy and Japan or their respective industry partners.
Applicants should read the terms and conditions of the published licence carefully before using it.
The GCAP OGL permits certain exports and transfers from the United Kingdom only. It also permits Italian and Japanese GCAP Authorised Contractors, operating in the UK for the purposes of the GCAP programme, but ordinarily domiciled outside of the UK to register for and use the licence for intangible technology transfers only. To be clear this licence does not authorise GCAP exports or transfers from any country other than the UK.

The licence comes into force on 14 August 2024. Subject to being able to comply with the conditions of the licence, any person seeking to rely on the licence must register online via SPIRE before using it.
