Poultrymeat Import Quota.

Introduction

This notice is to inform you of the next round of poultrymeat import quotas which are detailed in Annex 1 attached.

The application period

For the sub period 1 May 2022 to 30 June 2022 you may apply for import licences between 1 April 2022 and 7 April 2022.

It is your responsibility to check that the application is correct at the time of submission.

Note: We will reject any applications, securities or proof of trade received after 5pm on 7 April 2022.

Proof of trade – order numbers 05.4273, 05.4274 and 05.4422

If it is your first application of the quota year you must provide evidence to show that you have imported at least 25 tonnes of goods of the same description as those specified on the licence application, under a GB EORI number, during:

• the 12 month period from 17 September 2020 to 16 September 2021; and
• the 12 month period immediately prior to that.

Proof of trade – all other order numbers

If it is your first application of the quota year you must provide evidence to show that you imported at least 25 tonnes of goods of the same description as those specified on the licence application, under a GB EORI number, during:

• the 12 month period 1 April 2020 to 31 March 2021; and
• the 12 month period immediately prior to that.

However, if your application is for an order number which is not subject to the reference quantity requirement the proof of trade can be for any goods of a description falling within the poultry sector.

You must supply the original import document (C88) form, or a copy certified as a ‘true copy’ of the original stamped by Customs. We will not accept photocopies of the Customs stamp or scanned versions of these documents.

Supporting documents

If it is your first application of the quota year you must send us a valid VAT certificate when submitting your application. If you are registered as part of a group you must provide a valid VAT certificate that lists each company within the group.

Reference quantity

For order numbers 05.4211, 05.4214, 05.4215, 05.4216 and 05.4260 your application will be subject to a reference quantity.

The reference quantity is the average quantity of goods imported during:

• the 12-month period 1 April 2020 to 31 March 2021; and
• the 12-month period immediately prior to that.

For order numbers 05.4273, 05.4274 and 05.4422 your application will also be subject to a reference quantity.

The reference quantity is the average quantity of goods imported during:

• the 12-month period 17 September 2020 to 16 September 2021; and
• the 12-month period immediately prior to that.

The application must not exceed the reference quantity or, if it concerns a sub-period, must not exceed the proportion of the reference quantity corresponding with the sub-period.

For example:

Reference quantity - 10,000kgs

Sub-period split - 30%/30%/20%/20%

Reference quantity split 3000kgs/3000kgs/2000kgs/2000kgs

The reference quantity can only be made up of goods of the same description relating to the quota concerned.

Removal of reference quantity – order numbers 05.4067, 05.4068, 05.4212, 05.4213, 05.4251, 05.4254 and 05.4255

The reference quantity requirement has been removed for these order numbers for the remainder of the quota year. Applications for these order numbers can be submitted up to the maximum quantity available.

Declaration of independence

For order numbers 05.4067, 05.4068, 05.4069, 05.4211, 05.4212, 05.4213, 05.4214, 05.4215, 05.4216, 05.4251, 05.4254, 05.4255, 05.4260, 05.4273, 05.4274, 05.4410, 05.4411, 05.4412, 05.4420 and 05.4422 you must provide a declaration of independence (see Annex 2) which must contain:

• a declaration that you are not linked with any other person applying for the same order number; or
• if you are linked with another person applying for the same order number, a declaration that identifies that linked person and evidence that you regularly engage in substantial economic activities with other third parties.

Licence applications

In box 8, the country of origin:

• you must put a cross in the ‘No box for order numbers 05.4067, 05.4068, 05.4069, 05.4213, 05.4216, 05.4218, 05.4260, 05.4263, 05.4264, 05.4265 and 05.4422 and a cross in the ‘Yes box for all other order numbers.

in box 20, special particulars:

• you must state ‘Statutory Instrument 2020 No. 1432’ and the quota order number that you are applying under.

Licence security

Applications must be accompanied by a security of £10 per 100kgs for order numbers 05.4211, 05.4214, 05.4217, 05,4251, 05.4252 and 05.4253, £20 per 100kgs for order numbers 05.4067, 05.4068 and 05.4069, £35 per 100kgs for order numbers 05.4215, 05.4254, 05.4255, 05.4256, 05.4258 and 05.4259, £50 per 100kgs for order numbers 05.4212, 05.4213, 05.4216, 05.4218, 05.4260, 05.4264, 05.4265, 05.4410 and 05.4422, and £63 per 100kgs for order numbers 05.4273 and 05.4274.

In box 11 you should state:

• the amount of security expressed in UKP (£);
• the type of security, for example ‘block guarantee’, ‘cash’ or ‘single transaction guarantee’; and
• the trader number of the block guarantee holder if you are using another trader’s block guarantee.

If you are using another trader’s block guarantee you must make sure that your cross reference details are set up before you send us your application.

Note: We will reject your application if the cross reference is not set up and you do not submit security in another format within the application period.

We will not accept any amendments to block guarantees after the application period has closed. This includes cross reference amendments.

Licence validity

Licences for order numbers 05.4273, 05.4274 and 05.4422 will be valid from 1 May 2022 until 31 December 2022.

Licences for all other order numbers will be valid from 1 May 2022 until 30 June 2022.

Release of security

Security against the main electronic licence (excluding extracts) will be released automatically upon attribution of at least 95% of the licence quantity.

Transfer of rights

The rights of a licence may only be transferred to companies that have satisfied the proof of trade requirements detailed in this notice. The rights of a licence can only be transferred once, to the nominated transferee. Further transfers of rights are not permitted, other than to transfer the rights back to the original licence holder.

Animal and public health

To protect animal and public health, all products of animal origin may be subject to veterinary conditions or restrictions. You can call the Animal and Plant Health Agency Carlisle on 01228 403600 for advice on whether and under what conditions imports are allowed.
