Notice to Traders 65/23 - Milk Products Import Quota

Introduction

This notice is to inform you of the milk and milk products import quotas which are detailed in Annex 1 attached.

The application period – order numbers 05.4155 and 05.4595

You may submit your application for a licence between 1 August 2023 and 5pm on 7 August 2023.

It is your responsibility to check that the application is correct at the time of submission.

Note: We will reject any applications, securities or proof of trade received after 5pm on 7 August 2023.

The application period – order numbers 05.4195, 05.4513, 05.4514, 05.4515, 05.4521 and 05.4522

You may apply for import licences at any time during the year.

Proof of trade – order numbers 05.4155 and 05.4595

If this is your first application of the quota year you must provide evidence to show that you imported at least 25 tonnes of product from the milk products sector during each of the two periods:

  • 1 April 2021 to 31 March 2022; and
  • 1 April 2022 to 31 March 2023.

Proof of trade – order numbers 05.4195, 05.4513, 05.4514, 05.4515, 05.4521 and 05.4522

If this is your first application of the quota year you must provide evidence to show that you imported at least 25 tonnes of product from the milk products sector during each of the two periods:

  • 17 September 2020 to 16 September 2021; and
  • 17 September 2021 to 16 September 2022.

Proof of trade can be submitted on a spreadsheet detailing the following:

  • Entry number;
  • Date of entry;
  • CN code of the product imported;
  • Quantity imported;
  • Licence number (if applicable)

You must also be established, and registered for VAT, in the UK.

Inward Monitoring Arrangement Certificates (IMA1)

Applications for order numbers 05.4195, 05.4513, 05.4514, 05.4515, 05.4521 and 05.4522 must be accompanied by an IMA1 certificate

Licence applications

In box 8, the country of origin:

  • you must put a cross in the ‘No’ box for order number 05.4595 and a cross in the ‘Yes’ box for all other order numbers; and

in box 20, special particulars:

  • you must state the ‘Statutory Instrument 2020 No.1432’ and the order number that you are applying for.

Licence security

Applications must be accompanied by a security of £29 per 100kgs for order number 05.4155, £35 per 100kgs for order numbers 05.4595, 05.4195, 05.4514 and 05.4515, £10 per 100kgs for order number 05.4513 and £8 per 100kgs for order numbers 05.4521 and 05.4522.

In box 11 you should state:

  • the amount of security expressed UKP (£);
  • the type of security, for example ‘block guarantee’, ‘cash’ or ‘single transaction guarantee’; and
  • the trader number of the block guarantee holder if you are using another trader’s block guarantee.

If you are using another trader’s block guarantee you must make sure that your cross reference details are set up before you send us your application.

Note: We will reject your application if the cross reference is not set up and you do not submit security in another format within the application period.

We will not accept any amendments to block guarantees after the application period has closed. This includes cross reference amendments.

Licence validity

Licences for order number 05.4595 will be valid from 1 September 2023 until 30 June 2024.

Licences for order number 05.4155 will be valid from 1 September 2023 until 31 December 2023.

Licences (with IMA1 certificates) for all other order numbers will be valid from the issue date until the end of the eighth month following, but not later than 31 December of that year.

Release of security

Security against the main electronic licence (excluding extracts) will be released automatically upon attribution of at least 95% of the licence quantity.

Transfer of rights

The rights of a licence may only be transferred to companies that have satisfied the proof of trade requirements detailed in this notice. The rights of a licence can only be transferred once, to the nominated transferee. Further transfers of rights are not permitted, other than to transfer the rights back to the original licence holder.

Animal and public health

To protect animal and public health, all products of animal origin may be subject to veterinary conditions or restrictions. You can call the Animal and Plant Health Agency Carlisle on 01228 403600 for advice on whether and under what conditions imports are allowed.
