Details

This guidance provides information about the different types of sentence and cases which panels may come across. It details the possible Parole Board decision outcomes for prisoners serving each type of sentence and provides relevant dates for each sentence type.

The guidance highlights where the powers and procedures of the Board are affected by the type of sentence the prisoner is serving and details the process-related issues relevant to specific types of cases.

The guidance has been revised to reflect the following, along with some other minor updates:

  • The judgment in the case of Dich and Murphy [2023] EWHC 945 (Admin)
  • The Secretary of State’s Directions on Open Conditions of 1 August 2023
  • The Offenders (Day of Release from Detention) Act 2023
  • Cancellation of the policy on no deferrals in IPP cases where there is a Secretary of State view.
  • Some clarifications on the application of Sim for extended determinate recall cases.
