Previous informal and non-statutory guidance on processing certain immediate detriment cases ahead of legislation, in relation to the wider McCloud/Sargeant pensions litigation (immediate detriment referring to those who have already retired or will do so before the remedy to the discrimination is implemented), has been withdrawn.
This note sets out HMT’s best assessment at this point on the advisability of processing immediate detriment cases before new legislation to enact the McCloud remedy is in place, and the implications of this assessment for the Home Office guidance on processing immediate detriment cases published in August 2020 and revised in June 2021.
This provides informal advice but the overall responsibility for interpreting and applying the pension scheme regulations remains with each chief constable as the relevant scheme manager.
