Property Value Protection scheme: Privacy Policy

1. Introduction  

This Privacy Policy applies to all individuals who apply to the Property Value Protection (PVP) scheme. We process your information to administer and review your application.

This Privacy Policy explains what data we process, why we do so, how it is legal and your rights.

2. About us and this Privacy Policy  

This Privacy Policy is provided by Nuclear Waste Services (“NWS”, “we” or “us”). We are a ‘controller’ for the purposes of the UK General Data Protection Regulation (“UK GDPR”) and the UK Data Protection Act 2018 (“Data Protection Laws”).

We take your privacy very seriously. We ask that you read this Privacy Policy carefully as it contains important information about our processing and your rights.

4. Changes to the Privacy Policy  

We may change this Privacy Policy from time to time. Changes to the purposes for which we process your data will be highlighted to you.

5. Information we collect and what we use it for  

We collect information that you provide when applying to the PVP scheme to administer and review your application.

The information may include the following categories of personal data (not exhaustive):

  • Full name
  • Home address
  • Telephone number
  • Email address

Additional information that you provide to us to support your application which may include:

  • Your photo ID
  • Biographical details
  • Financial information (including bank details)
  • Personal characteristics such as health information and age

6. How we keep your personal data secure  

We implement appropriate technical and organisational measures in order to protect your personal data against accidental or unlawful destruction, accidental loss or alteration, unauthorised disclosure or access and any other unlawful forms of processing. We aim to ensure that the level of security and the measures adopted to protect your personal data are appropriate for the risks presented by the nature and use of your personal data.

7. Lawful grounds for processing your information  

NWS will collect and process your personal data in relation to your enquiry about or application for the PVP scheme. NWS is permitted to do this so that we can enter into a contract with you if your application is successful. NWS also has a public task to develop a Geological Disposal Facility (GDF) and is allowed to process your personal data on the basis that it is necessary for the performance of a task carried out in the public interest which is laid down by law.

You are not required to provide sensitive information (referred to as special category data under UK GDPR) such as health details to support your application. If you wish to do so, we will process this based on your explicit consent. You may withdraw your consent at any time and ask us to delete this data by notifying us at the contact details in the ‘How to contact us’ section.

8. Organisations that we may share your data with  

To process your application to the PVP scheme, we will share your personal information with the PVP Panel. The PVP Panel is made up of five members, being a representative from each of NWS and the Nuclear Decommissioning Authority (NDA), and three external members. It will also be shared with the PVP scheme decision-maker, who is the NWS Chief Executive Officer or their delegated representative. It may be reviewed by the NWS Board if there is a conflict of interest. Limited information, such as name, address and telephone number may be shared with external suppliers conducting property valuations.

Other than stated above, we do not pass your personal data to third parties, unless required to do so by law or unless we have your consent to do so.

We do not sell or exchange your information with other companies or organisations for marketing purposes.

9. Retention and deletion of your personal data  

We keep personal information only for as long as we are required to by law, or, where there is no specific legislation, for as long as we need to for the particular reason we have it. We do not hold information indefinitely unless we are legally obliged to do so. Application data will be kept for 6 years plus the current year.

10. Your rights 

You have the following rights under Data Protection Laws: - Right to object to processing of your personal data - Right of access to personal data relating to you (data subject access request) - Right to correct any mistakes in your personal data - Right to ask us to stop contacting you with direct marketing (such as newsletters) - Right to prevent your personal data being processed - Right to withdraw your consent - Right to erasure

If you would like to exercise your rights, please contact us at the details set out above in the ‘How to contact us’ section. Please note that we can’t always stop all the ways we process your personal information when you ask us to, as there may be other fair and lawful reasons for needing to continue to process this, however we will tell you where this is the case.

We will respond to any rights that you exercise within a month of receiving your request, unless the request is particularly complex, in which case we will respond within three months.

11. Complaints 

When you provide us with information, we will process it in accordance with the Data Protection Laws. If you believe your information has not been handled in accordance with this Privacy Policy by NWS, please contact us using the details in the ‘How to contact us’ section.
