How to make representations on application to High Court in relation to the application of the residual funds held by the charity.

Details
The Charity Commission is intending to make an application to the High Court in relation to the application of the residual funds held by The Dove Trust (registered charity number 287401).
The Commission opened a statutory inquiry into the charity in 2014 and shortly after appointed an interim manager to address serious governance concerns at the charity.
Due to there being no funds available at the charity to cover the remedial costs of an interim manager, the Commission took the unusual step of covering the costs so as to ensure as much money as possible could be recovered.
The interim manager has successfully recovered significant funds during this period and has been working to return funds to the charity’s creditors. He has published regular updates about this on the charity’s website.
The interim manager is seeking to wind up the charity and once this has been completed the Commission will discharge him and conclude this complex and long running inquiry. To progress this the Commission is applying to the High Court for permission to apply any remaining funds towards the costs of the interim manager’s fees so that the charity can be efficiently wound up.
As this is an unusual step, the Commission is making public the statement that has been produced in support of the application (), so that anyone with a potential interest in this matter can seek independent legal advice and/or make representations.
Anyone wishing to make representations should send these by 4:00pm on 17 January 2020 to the Commission’s Litigation team at Litigationandreview@charitycommission.gov.uk or PO Box 211, Bootle, Merseyside L20 7HS.
