1. Request under the Freedom of Information Act 2000

Thank you for your email, received on 18 January 2023, in which you requested information from the office of the Pubs Code Adjudicator (PCA) under the Freedom of Information Act 2000.

The Freedom of Information Act 2000 entitles you to:

  • know whether the information you have requested is held by the PCA; and

  • be provided with that information, subject to any exemptions in the Freedom of Information Act 2000 which may apply.

You have requested the following information:

Please could you provide the following information under the freedom of information act covering the last 12 months, or the most recent 12 month period recorded:

1) Has the organisation used agencies to recruit temporary/contractor staff?

1a If so please confirm the total agency spend on temporary/contractor staff??

1b Please provide a breakdown of your answer to question 1a, splitting the spend by job title/specialism

2) Has the organisation used agencies to recruit permanent staff?

2a If so please confirm the total agency spend on permanent staff?

2b Please provide a breakdown of your answer to question 2a, splitting the spend by job title/specialism

3) The contact name of the person responsible for dealing with permanent recruitment?

4) The contact name of the person responsible for dealing with temporary/contractor recruitment?

I can confirm that the PCA does hold information relevant to your request.

1) In the 12 month period from 1 January 2022 to 1 January 2023 the PCA has recruited temporary/contractor staff using the approved Crown Commercial Service Public Sector Resourcing (PSR). PSR is a single supplier agreement which public sector authorities can use to hire contractors and temporary workers. Further information about PSR can be accessed here.

During this period the PCA’s spend was as follows:

2) The PCA has not used any agency for recruitment of permanent staff. The PCA cannot employ any staff direct. Under paragraph 9 of Schedule 1 to the Small Business, Enterprise and Employment Act 2015 the PCA may make arrangements for persons to be seconded to the PCA Office to serve as staff. The arrangements may include provision for payment by the PCA to the organisation who employs the staff member, to an agency where that is relevant, or direct to the seconded staff member. The PCA Office therefore does not have any employees and as such no permanent staff.

3) For the reasons at point 2 above there is no person at the PCA responsible for dealing with recruitment of permanent staff as the PCA cannot employ any staff direct.
