  1. Section 3 has been amended to explain our practice where a single application is made to register two or more charges at the same time and their priority order differs from their dates of creation.

  2. Section 3 has been amended to clarify when a plan should be included with a charge of part.

  3. Sections 3 and 15 have been amended to refer to the Economic Crime (Transparency and Enforcement) Act 2022.

  4. Section 4 has been amended to clarify when we will enter the note referred to in section 859H of the Companies Act 2006.

  5. Section 5 has been amended to clarify when a restriction will not be automatically cancelled on a discharge of a charge.

  6. Section 4 has been amended to refer to the correct section of the Companies Act 2006. Section 14.1 has been amended to clarify that a digital mortgage can be used only to create remortgages of a borrower’s existing property. Section 14.2 has been amended as the service is no longer in the private phase.

  7. Section 6 has been amended to clarify that an application to register a lender’s obligation to make further advances must be made by the lender or their conveyancer.

  8. A new section 14 about digital mortgages has been added to this guide.

  9. Section 11 has been amended to refer to the register completion sheet rather than the title information document.
