Regulatory Finding
This regulatory notice updates, and is intended to be read in conjunction with, the previously published enforcement and regulatory notices[footnote 1] and is a result of ongoing regulatory engagement with St Andrews Community Housing Association Ltd (St Andrews). The regulator has notified St Andrews that it is proposing to exercise its power to de-register St Andrews from the register of social housing providers under section 118 of the Housing and Regeneration Act (HRA) 2008. In accordance with section 118(2) of the HRA 2008, the regulator has provided St Andrews with 16 days’ notice of the proposal and the opportunity to make representations to the regulator during that notice period. Following the expiry of that notice period, having considered any representations submitted by St Andrews, the regulator will make a decision.
The Case
The regulator maintains a register of providers of social housing. To be eligible for registration, an organisation must demonstrate its eligibility as set out in section 112 of the HRA 2008. The relevant criteria set by the regulator referred to in s112(3) are set out in guidance for new entrants on applying for registration as a provider of social housing[footnote 2] and include that a provider must meet the Governance and Financial Viability Standard at the point of registration and demonstrate it can sustain its financial viability on an ongoing basis. Under section 118 of the HRA 2008, the regulator may remove a private registered provider from the register if the regulator thinks it is no longer eligible for registration.
St Andrews remains in breach of the Governance and Financial Viability Standard. The regulator has assessed that St Andrews is unable to demonstrate that it can sustain its viability on an on-going basis. As a result, St Andrews cannot demonstrate that it meets the relevant criteria under section 112(3) of the HRA 2008. The regulator has a statutory duty to maintain the register of social housing providers.

St Andrews is a not-for-profit provider registered in December 2009. Based on its most recent statistical data return, St Andrews owns and manages 4 units of social housing which includes one shared ownership property.
