Dear Owen and Roger,

I am grateful to the ACMD for their advice on remimazolam (or ‘Byfavo’). I have set out each recommendation and the government’s response below.

Recommendation 1

The ACMD recommends that remimazolam should be controlled as a Class C drug under the Misuse of Drugs Act 1971.

Government response

The government accepts this recommendation and will implement it when Parliamentary time allows.

Recommendation 2

The ACMD recommends that remimazolam should be scheduled under Schedule 4 (Part 1) of the Misuse of Drugs Regulations 2001.

Government response

The government accepts this recommendation and will implement it when Parliamentary time allows.

Thank you again for your advice.

Rt Hon Chris Philp MP

Minister of State for Crime, Policing and Fire
